Microsoft permanently barred from selling Word

Microsoft has been ordered by a US District Court to halt sales of its popular word processing application, Word. Judge Leonard Davis has ruled that the software-giant is guilty of patent infringement and has prohibited it from selling, importing, testing, demonstrating or marketing any Microsoft Word products able to open XML, DOCX, or DOCM files (XML) files containing custom XML.

Plaintiff i4i sued Microsoft in March 2007 claiming that it violated a 1998 software patent (number 5,787,449) for a document system that eliminated the need for manually embedded formatting codes. One of the fundamental features of the markup language XML is that it is readable by both people and machines. XML allows developers and users to define their own tags for data - unlike other markup languages like HTML which have predefined tags.

Microsoft has already paid $200 million after a federal jury ruled that the XML properties of Word 2003 and Word 2007 infringed on i4i's patent. Redmond accumulated another $77 million in fees after the most recent ruling, $40 million for willful patent infringement and $37 million in prejudgment interest. The company must comply within 60 days and is planning to appeal the verdict.

Hackers attack Twitter, Facebook also slowed

A hacker attack Thursday shut down the fast-growing messaging service Twitter, and Facebook also said it was looking into possible site problems.

Twitter said in its status blog Thursday that it was "defending against a denial-of-service attack," in which hackers command scores of computers to a single site at the same time, preventing legitimate traffic from getting through.

For Twitter users, the outage meant no tweeting about lunch plans, the weather or the fact that Twitter is down.

The Twitter outage began at about 9 a.m. ET, said Ken Godskind, chief strategy officer at Web performance monitoring company AlertSite.

The site still had lingering access problems midday (local time), though both Twitter and Facebook seemed to be functioning at least intermittently, giving cubicle-bound social media addicts a collective sigh of relief.

Allison Koski, a public-relations manager in Manhattan, said she felt "completely lost" without Twitter.

"I had to Google search Twitter to find out what was going on, when normally my Twitter feed gives me all the breaking news I need," Koski said.

Incidentally, Facebook also seemed to be experiencing problems. Company spokeswoman Brandee Barker said the company was looking into it and would have an update "as soon as possible."

Technology business analyst Shelly Palmer told AP Radio that denial-of-service attacks are a reality of the information age.

"People tend to want to take sites that are very public and go after them," said Palmer, managing director of Advanced Media Ventures Group. "In fact you'd be surprised how many sites for major companies are really attacked on a daily basis. This is a crime, it's a real crime and it should be treated that way."

Earlier this week, Gawker Media, which owns the eponymous media commentary blog and other sites, was also attacked. In a blog post, Gawker said Tuesday it was attacked by "dastardly hackers," leading to server problems that caused network-wide outages Sunday and Monday. It was not immediately clear whether those attacks were related to Twitter's.

EBay's PayPal shut globally for an hour

EBay Inc's online payments service, PayPal, shut down worldwide for about an hour on Monday after the Internet retailer encountered "internal" problems with the fast-growing division.

The outage began at 10:30 a.m. Pacific Time and affected all users for about an hour. All customers had regained service as of 3:30 p.m., eBay spokesman Anuj Nayar said.

"I haven't heard the absolute clear definition of what happened from the engineering team yet," he said. "I can confirm that it was an internal problem, not an external problem."

EBay, facing increasing competition from Amazon.com and coping with weak business at its MarketPlaces auctions and retail division, had been relying on PayPal to help drive future growth.

PayPal, which accounts for roughly a third of eBay's sales but a smaller proportion of profits, has about 75 million active users and is the world's largest Internet-based payment system. It handles $2,000 a second in online transactions, Nayar said.

Sales at PayPal rose 11 percent while revenue slid 14 percent at MarketPlaces in the second quarter.

Analysts discounted a huge financial blow for eBay from Monday's incident.

"I wouldn't expect it to be a large monetary loss for them. Overall, PayPal is a relatively small part of eBay's profitability," Kaufman Bros. analyst Aaron Kessler said.

PayPal accounted for about 16 percent of eBay's profit in the second quarter, he added.

"An occasional server shutdown happens to a lot of companies. Obviously you don't want to have it happen more than a couple of times a year or you do start to have brand or reputation concerns. But we've seen issues with Google Inc, Netflix Inc, and Amazon.com Inc over the last couple of years, so I don't think an isolated incident is a huge deal for these companies.

"I don't think most people view it as material to their earnings or revenue," he said.

EBay shares, which gained 3.7 percent in the regular session, dipped 2 cents to $22.02 in after-hours trading.
